1. SCOPE OF GUARANTEE The HEICO SPORTIV Guarantee for the product specified in this Guarantee Certificate covers defects in materials and processing which existed at the time of the stated product's delivery or arise during the Guarantee Period. This Guarantee is warranted exclusively to end users. The Guarantee is valid for a period of 36 months commencing on the product's delivery date, which must be entered into the Guarantee Certificate, and is effective in European Union (EU) member states.
For tuning works, the Guarantee commences on the date of the initial registration of the vehicle, regardless of the installation date; in this case, it is limited to a maximum mileage of 100,000 km.
For the first 24 months following the initial registration, HEICO SPORTIV will assume the maintenance costs analogously to the Works Guarantee. Excluded herefrom are all incidental costs including but not limited to: loss of earnings; costs ensuing from loss of use; costs for overnight accommodation; attorney and court costs; postage and telephone costs; and costs for operating materials (oils, cool-ant). In months 25 - 36 following the initial registration, HEICO SPORTIV offers a guarantee, as set out in the matrix hereunder:
| All components and modules not set out in the aforementioned table are excluded from the Guarantee.
HEICO SPORTIV shall at its own cost remedy identified material and processing defects which existed at the time of delivery or arise during the Guarantee Period. HEICO SPORTIV elects the measures to remedy the defects at its own discretion. The Guarantee is limited exclusively to products which are manufactured by HEICO SPORTIV. The Guarantee does not cover other products such as tyres or other components covered by other manufacturers' guarantees.
The Guarantee does not cover:
Parts which have been rendered inoperative due to normal attrition or which are replaced in the course of normal service and maintenance work.
2. CONDITIONS FOR GUARANTEE CLAIMS The recognition of a guarantee claim requires fulfilment of the following conditions:
the data record sheet for control devices was presented to HEICO SPORTIV, fully completed, following the installation of said devices
the vehicle was serviced and maintained by a VOLVO-authorised VOLVO passenger-car workshop in accordance with VOLVO's vehicle-specific maintenance terms within the prescribed temporal or mileage limitations. Proof thereof shall be provided by means of a contiguously completed VOLVO service log and, on request, invoice receipts
only VOLVO-prescribed oils and fuels were used
the product was deployed under normal operating conditions and, in particular, that it was not incorrectly handled or exposed to excessive strain, for example but not limited to: motorsport competitions or unauthorised towing loads
security seals (e.g. on control devices) are intact
the pertinent operating instruction was observed
3. PERFORMANCE AND COMPENSATION The HEICO SPORTIV Guarantee entitles the customer to cost-free replacement or cost-free repair of the defective parts using the most economic method and HEICO SPORTIV's technical guidelines. The replacement of complete aggregates (such as the engine or gears) will be determined entirely by the cost issue in the above-mentioned sense. HEICO SPORTIV is under no replacement obligation if the damage can be remedied by a reasonable repair.
The principle of maximum cost-efficiency applies, in other words:
Repair rather than replacement or vice versa
Employment of HEICO SPORTIV's prescribed repair technique
3.1. Cost of wages Wage costs will be compensated in accordance with Volvo VST and a guarantee cost rate of € 55.00 net / hour.
3.2. Cost of materials The repayment of expenses for materials shall be based on the workshop purchase price (stock order) plus 10%. Volvo's valid purchase prices on the date of the repair shall apply. Incidental acquisition costs will not be borne.
3.3. Towing cost Insofar as the costs are not covered by the Volvo Mobility Guarantee, HEICO SPORTIV will reimburse a maximum of € 150.00 (one hundred fifty euros) on presentation of appropriate receipts.
3.4. Rental car Costs of € 35.00 (thirty-five euros) net per day will be borne for up to a maximum of five days.
Additional costs resulting from furnishings, parts, bodywork or other installations which were not de-livered or rendered by HEICO SPORTIV or Volvo and which obstruct or hinder the Guarantee performance are not covered by the Guarantee.
Ownership of all parts replaced in the framework of this Guarantee is transferred to HEICO SPORTIV. HEICO SPORTIV retains the right to inspect the replaced parts. If, after inspection, a defective part cannot be deemed eligible under the Guarantee, the corresponding replacement amount will be charged back.
4. EXCLUSIONS FROM THE GUARANTEE The Guarantee shall be rendered ineffective insofar as HEICO SPORTIV can prove that a material or processing defect which was remedied under the terms of the Guarantee was in all likelihood ascribable to one of the following:
the fault / defect was worsened by the customer failing to immediately take suitable measures at the time at which he became, or could have become, aware of the the fault / defect, in particular not having informed HEOCO SPORTIV immediately on discovery of the fault / defect and engaging HEICO SPORTIV with its rectification
the product was changed or modified
the vehicle was involved in an accident or otherwise subjected to external forceful impact
inappropriate or defective maintenance or repair work (including software settings)
The following items do not constitute defects under this Guarantee and cannot therefore be reimbursed:
normal attrition
repair work or settings covered by regular maintenance work
normal use of expendable parts
HEICO SPORTIV provides no warranties and assumes no further obligations other than those stated expressly in this Guarantee Certificate.
The customer's statutory rights are not affected thereby and remain effective notwithstanding this Guarantee.
5. STATUTE OF LIMITATIONS FOR GUARANTEE CLAIMS:
all warranties under this Guarantee are excluded on expiry of the Guarantee Period set out in Item 1 herein.
excluded from the aforementioned statute of limitations are defects of which HEICO SPORTIV or the merchant from which the product was purchased were notified in writing during the Guarantee Period, but whose rectification was not possible during the Guarantee Period due to distance or work load. Such defects are nevertheless covered by the Guarantee if an appointment was agreed during the Guarantee Period.
the statute of limitations for claims for defects associated with rectification measures is three months after the workshop or HEICO SPORTIV has stated that the defect has been remedied or did not exist, no earlier however than the end of the Guarantee Period.
6. PROCEDURE ON OCCURRENCE OF A GUARANTEE TRIGGERING EVENT Should you discovered a defect in a product you purchased, please proceed as follows: 1. Whenever possible, take your vehicle to the merchant from whom you purchased the product and inform us simultaneously at:
